These Terms of Use ("Terms") govern your access to and use of the CaseMate Suite platform, including all tools, calculators, features, content, and services provided on or through the website (collectively, the "Site" or "Service").

By creating an account, logging in, or using any part of the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site.

1. Eligibility and Account Access

The CaseMate Suite is designed for use by attorneys and professionals familiar with property division concepts. While access to the platform is not restricted to licensed attorneys, users are responsible for ensuring that any outputs are appropriately reviewed and interpreted by a qualified professional where necessary. By registering for an account, you represent and warrant that:

• You are at least 18 years old;
• You have the legal capacity and authority to enter into these Terms;
• The information you provide during registration is accurate and complete;
• You will update your information as necessary to remain accurate.

Accounts are intended for individual use and may not be shared. You are responsible for maintaining the confidentiality of your login credentials. If you suspect unauthorized access to your account, you must notify us immediately.

2. Subscription and Billing

CaseMate Suite is a subscription-based service. Subscription plans, pricing, and billing cycles are described during the signup process and in your account dashboard. Payments are processed securely by our third-party payment processor, Paddle.com. By purchasing a subscription, you agree to Paddle’s applicable terms, privacy policy, and billing practices.

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan selected) and will automatically renew unless canceled through your account settings or Paddle’s customer billing portal prior to the renewal date.

Refunds are provided at the sole discretion of Paddle and may be refused. Refunds will be processed within 14 business days from the request date. Paddle will refuse a refund request if it finds evidence of fraud, refund abuse, or other manipulative behavior that entitles Paddle to counterclaim the refund.

This does not affect your rights as a consumer in relation to products that are not as described, faulty, or not fit for purpose, where such rights are provided under applicable law.

Failure to pay subscription fees may result in suspension or termination of your access to the service. After 60 days of inactivity with no active subscription, your account data may be permanently deleted in accordance with our Privacy Policy.

We reserve the right to modify subscription fees, billing cycles, or introduce new fees. Any changes will be communicated at least 30 days in advance via your registered email address or through the service dashboard.

3. Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site for any illegal or unauthorized purpose;
• Attempt to gain unauthorized access to any part of the platform, data, or user accounts;
• Interfere with or disrupt the security, integrity, or performance of the Site;

Use of the Site does not create an attorney-client relationship between you and VBD Global Services, LLC or CaseMate Suite. Communications with the platform are not protected by attorney-client privilege.

Upon termination, your right to access the Site will cease, and your data will be handled in accordance with our Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the jurisdiction of such courts.
